JOINT WINDSOR TOWN COUNCIL,
WINDSOR REDEVELOPMENT SUCCESSOR AGENCY
AND
WINDSOR WATER DISTRICT
MEETING

Call to order a meeting of the Town Council (Council), the Windsor Redevelopment Successor Agency (Agency) and the Board of Directors of the Town of Windsor Water District (District).

Members of the public wishing to speak to the Council on any Consent Calendar item or any item not listed on the agenda may do so at this time. Pursuant to the Brown Act, the Council is not allowed to consider issues or take action on any item not listed on the agenda during this period. Each Public Comment is normally restricted to three (3) minutes in length.

Consent Calendar items are viewed as routine in nature or require little or no further discussion by the Council, public or applicant, and will be acted upon through a single motion. 

Approve the regular Town Council meeting minutes of September 6, 2023, and the special Town Council meeting minutes of September 25, 2023.

Approve check numbers 96542 through and including 96751 and 25119 through and including 25210 (payroll).

Approve Change Order 3 to Task 1 of the Professional Services Agreement with Rincon Consultants, Inc. in the amount of $53,968 to prepare the environmental review documents necessary for the Quail Acres Project and authorize the Town Manager to execute said agreement on behalf of the Town.

Approve Amendment No. 3 to the Professional Services Agreement with GHD, Inc. for the Dawn Way Drainage Conveyance Improvements Project in an amount not to exceed $58,929 and authorize the Town Manager to execute said amendment on behalf of the Town and any contract amendments up to 20 percent of the new contract amount.

Adopt a resolution accepting the work performed by WestPac Construction for the construction of the Brooks Road South at Natalie Drive Enhanced Crosswalk Project and directing the Town Clerk to record a Notice of Completion.

1. Adopt a Town Council resolution accepting the public improvements associated with the Los Amigos Subdivision 280 Arata Lane.
2. Adopt a Windsor Water District resolution accepting the Windsor Water District facility improvements associated with the Los Amigos Subdivision 280 Arata Lane.

1. Adopt a Town Council resolution accepting the public improvements associated with the 330 Arata Lane Subdivision.
2. Adopt a Windsor Water District resolution accepting the water and sanitary improvements associated with 330 Arata Lane Subdivision.

1. Adopt a Town Council resolution accepting the Public Improvements for the Overlook Subdivision as shown on the Overlook Subdivision improvement plans and designate the intersections of Barbara’s Lane and Mitchell Lane and Barbara’s Lane and Windsor Road as stop controlled intersections. 
2. Adopt a Windsor Water District resolution accepting Windsor Water District facilities improvements as shown on the Overlook Subdivision Improvement plans. 

Adopt a resolution authorizing the Town Manager to enter, execute, and deliver a STD 213, Standard Agreement, and any and all other documents required or deemed necessary or appropriate to secure or evidence the AHSC Program Grant Award from the California Department of Housing and Community Development (Department) and to participate in the AHSC Program, and all amendments thereto (collectively, the AHSC Program Award Documents).

Adopt a resolution approving the Mayoral appointment of Zoey Arent to serve on the Public Art Advisory Commission as youth commissioner, pursuant to California Government Code Section 40605, with ratification by Council.

Adopt a resolution approving a first amendment to the Town Manager Employment Agreement with Jonathan Davis.

Public Hearing items will begin at the time shown, or as close thereafter as possible, to allow for completion of the item. 

Adopt a resolution to deny the appeal and uphold the Planning Commission’s decision to approve a Use Permit for a Billiards Hall at 8928 Lakewood Drive.

Hold second reading, by title only, and adopt an ordinance updating information in Title VI (Fire Prevention and Protection), removing redundancies from Title VII (Building and Housing), and making numbering corrections in both sections of the municipal code.

By at least a four-fifths vote, adopt an urgency ordinance measure, pursuant to California Government Code Section 65858, extending the provisions of Zoning Ordinance Chapter 27.38: Temporary Housing Measures for Recovery from the Nuns and Tubbs Fires for 18 months.  

Those matters requiring discussion and/or action by the Council will be heard at this time. Regular Calendar items will be taken up and acted upon separately. 

1. By motion, determine that the higher energy performance measures being proposed by the Town under the proposed Ordinance are cost effective as documented in the 2022 Cost-effectiveness Study for Single-Family New Construction (last modified on June 20, 2023), and 2022 Cost-Effectiveness Study for Multi-Family New Construction (last modified on June 20, 2023), collectively, “Study.”
2. Hold first reading, by title only, an ordinance amending Windsor Municipal Code Title VII, “Building and Housing,” to require higher energy performance for residential single-family and multi-family new construction.
3. By motion, authorize the Town Manager to submit an application to the California Energy Commission (CEC) for review and approval of the Higher Energy Performance Residential Reach Code as proposed under the proposed ordinance upon adoption by the Town Council.

Discussion regarding amending the Town of Windsor Municipal Code related to Planning Commission.

The next meeting of the Town Council is a special meeting scheduled for Thursday, October 5, 2023, at 6:00 p.m. in the Civic Center Council Chambers located at 9291 Old Redwood Highway, Building 400 in Windsor.
